Terms & Conditions
These terms and conditions of the this rental contract signed by Renter, and all addenda, together constitutes the Contract (“Rental Contract”) for the rental of the RV trailer rental also known as a “travel trailer” or a “camping trailer rental” and all its equipment, hereafter called “Rental” or “Rental Vehicle.” The Rental Contract is between Renter and Adventure in Camping, Mammoth, Incorporated, a California corporation (hereafter called AIC).
NATURE OF THIS RENTAL CONTRACT. This Rental Contract is solely for the purpose of creating a bailment that allows Renter to use the Rental Vehicle as permitted by this Rental Contract. Renter acknowledges that the Rental Vehicle is owned by AIC. No one other than AIC may transfer rights or obligations under this Rental Contract. Any attempted transfer or net lease of the Rental Vehicle by anyone other than AIC is void. Renter is not an agent of AIC. No one may service or repair the Rental Vehicle without AIC’s express written approval. AIC makes no express or implied warranties, including any warranty that the Rental Vehicle is fit for any particular purpose.
DEFINITIONS: Adventure in Camping, Mammoth, Incorporated (AIC, “we, us, our”) includes all owners, shareholders, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of Adventure in Camping, Mammoth, Inc. The Renter (Renter, “you, your, he, she, they”) includes you as the renter, and anyone else in your vacation party including friends, relatives, spouses, significant others, any minor children, and any other occupants of the Rental Vehicle under your custody, care and control, regardless age or the amount of time you or anyone else occupies or uses any and all activities related to the Rental Vehicle, operation, or use of equipment provided by AIC. AIC provides travel trailer rentals, the Rental Vehicle (herein after referred to as vacation, camping rental, vacation rental, rental vehicle, and or trailer rental).
DISCLAIMER: This waiver and release is applicable to all renters, occupants and users of rental equipment provided by AIC. If any other rental agreement is used in addition to or in conjunction with this waiver and release, the provisions of this waiver and release shall prevail over any other clauses in the rental agreement that are inconsistent with this release. The renter agrees that he/she is also signing on behalf of all minors. The renter further agrees to full responsibility and understands they are personally liable for any damages to all individuals.
EXPRESS ASSUMPTION OF RISK: The renter agrees that he/she is renting, operating, and using equipment provided by AIC at your own risk. The renter agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental and equipment, and assumes all risk of injury, illness, damage, or loss that might result, even if the risks arise out of the negligence or fault of AIC, which may be both foreseen and unforeseen. Renter agrees to follow all laws and regulations regarding the use of the rental trailer within the campground. Renter agrees to receive instructions on the operation, use, maintenance, and safety precautions required on the use of all systems of the rental, including but not limited to, use of liquid propane, appliances, and electrical systems. In the event the renter is not present when the rental is delivered and set up by AIC staff, the renter agrees to call or text 760-935-4890 to arrange instruction at a later time. The renter assumes all risk and agrees if he/she decides not to contact AIC for instruction of the rental either over the phone or in person, it is implied the renter understands how the rental operates and agrees no further instruction is necessary. Renter agrees to operate the rental trailer in a safe manner and report any unsafe or damaged portion of the rental trailer to AIC.
WAIVER/RELEASE OF LIABILITY: By execution of this release, the renter agrees that Adventure in Camping, Mammoth, Inc. shall not be liable for any damages arising from personal injuries sustained by the undersigned (renter), any minor children, and any other occupants under the undersigned’s custody, care and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by AIC. The renter assumes full responsibility for any such injuries or damages which may occur, and further agrees that AIC shall not be liable for any or theft of personal property.
LIABILITY TO THIRD PARTIES: The renter agrees that he/she will indemnify and hold harmless Adventure in Camping, Mammoth, Inc. for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and occupants of other rentals and equipment provided by AIC.
PERSONAL RESPONSIBILITY: The renter certifies that all renters, occupants and operators of equipment have no physical or mental condition that preclude him/her from renting, operating or using the equipment provided by AIC and you are not doing so against medical advice. You and renters, occupants and operators acknowledge and understand that you are obligated to follow instruction and the intended use of all equipment, including rental trailer, in the safest manner and you can minimize your risk of injury by doing so. This includes the use of all safety equipment provided. You and renters, occupants and operators acknowledge and understand that any changes, modifications and or moving of any equipment and or the rental trailer provided by AIC is not allowed and increases risk of injury. If trailer rental or equipment is moved, you will be responsible for any damages as a result, as well as the cost for servicing equipment or rental trailer. You and renters, occupants and operators acknowledge and understand that if you observe any unusual hazard, which you believe jeopardizes your personal safety or that of others, you will immediately report said hazard to the attention of AIC and any other appropriate agencies.
CHECK IN/CHECK OUT and LATE ARRIVAL: Rental Vehicles are generally parked daily from 12:00pm-6:00pm PST; however, in some cases may be parked earlier than 12:00pm or later than 6:00pm. Prior to your arrival, you will be assigned a two (2) hour parking time window. AIC will do our best to have your trailer delivered during the two hour window that was assigned to you. Please note that delivery could be as late as 6:00pm or later. If you are choosing your campsite the day of your arrival or if you have not already communicated your campground and campsite number to the AIC office, you must give this information to the AIC office no later than 2:00pm PST on the check in day. Failure to relay your campsite by 2:00pm may result in an additional charge for parking fees and or your rental may not by parked until the next day after your arrival date. If you plan to arrive after your assigned parking time window or after our normal operating hours, you will be required to have a reserved campsite so we may deliver your rental ahead of your arrival. AIC is not able to choose a campground or campsite and pre-park your rental without your pre-arranged plans you secure. AIC will not refund any unused portion of your stay for any reason should you not arrive on the first day of your vacation or should you vacate the rental prior to your scheduled departure date. All trailer rental and extra equipment rentals are charged by the night regardless of your arrival time to the area. AIC check in and out times will vary from campground and RV park check in and out times.
Due to the distance and time required to pick up your rental trailer, your check-out time is strictly enforced. A late check-out fee of $100.00 per hour will apply if you leave any time after your pre-arranged check-out time (please review your check in form or rental confirmation for your assigned check out time or call or text 760-935-4890). Requests for late check-out times will be honored based on availability and must be pre-arranged with the rental office.
Any extra equipment rented by you and not used (chairs, firewood, bbq, etc.) will not be refunded.
ACTS OF GOD, NATURE, AND UNCONTROLLABLE EVENTS: AIC will not refund any portion of your rental in the event that your rental is affected by an act of God including but not limited to pandemics, epidemics, major storms or weather events, road closures, forest closures, campground closures, or closure of a specific campsite. We hope to see the campgrounds open on the projected dates; however, it is important you understand opening dates may change based on winter snowfall, runoff water, damage to the campground, etc. Although some campgrounds may not open in time to accommodate your camping dates, there are other campgrounds to choose from in the surrounding area we service. If there is an open campground with an open campsite that matches your dates, AIC will provide your rental to that open campground. AIC will not refund any portion of your rental in the event the campground or campsite of your choice is not available.
RENTAL CHANGE: If you must change or reschedule your rental for any reason, you may do so at least thirty one (31) days prior to your original arrival date. Any change will result in a non-refundable $25 change fee. Changes made to your rental thirty (30) days or less prior to your arrival date will be treated as a cancelled rental and subject to cancellation policy and fees. Occasionally and generally due to circumstances out of our control, AIC may need to change your trailer model. AIC reserves the right to change your trailer model based on availability. In the event your rental model is changed, AIC will do our best to choose a model with a similar floor plan and same year or newer. In rare cases AIC may upgrade your trailer altogether. In this event, AIC will generally choose a newer and larger model that sleeps at least the same number of people as the rental trailer you had reserved. AIC will also do our best to notify you of the change.
DEPOSIT AND PAYMENT: Unless otherwise noted, a deposit equaling fifty percent (50%) of the total amount of your rental amount must be received no later than 48 hours after the date you made your rental. Once AIC has received your deposit, your rental is considered confirmed and AIC will send you an email receipt to the email address we have on file. This deposit is considered payment and will be applied towards your total rental amount. All rentals must be paid in full thirty (30) days prior to your arrival date. AIC requires you have a credit card on file, kept confidential. Rentals without an initial deposit paid or with a balance due will not be honored, and cancellation fees may be applied as a result of non-payment. If you have a balance due on a confirmed rental, AIC will automatically process and charge the balance due to the credit card on file prior to your arrival in compliance with these terms and conditions, unless a new credit card is submitted for payment. Payment of deposits and rental fees signifies acknowledgement and acceptance of the rental for the dates and times listed in your confirmation email and the agreement to these terms and conditions. Furthermore, you agree to forward all payments by due dates sent to you.
PAYMENT INFORMATION: AIC accepts money order, Visa, Mastercard, discover and American Express for payment. AIC does not accept personal checks.
CANCELLATIONS: If you must cancel your rental, you must notify AIC at least thirty one (31) days prior to your arrival date. Your deposit will be refunded less a $100 cancellation fee. Cancellations received 30 days or less than prior to your arrival date are non-refundable and subject to forfeiture of total payment. All cancellation fees are subject to applicable taxes. AIC reserves the right to apply any portion of a refund to a future credit on file and applied to a future rental. Due to the limited quantity of available rental trailers and the advance nature of trailer rental vacations, please understand AIC will not make any exceptions to our cancellation policy due to personal emergencies, work conflicts, weather, specific campground closures, forest closures, Covid-19 or unavailability of specific campsites. For these reasons, AIC strongly encourages you to purchase trip insurance that will cover the cost of your trailer rental in the event you need to cancel. AIC does not offer insurance nor is AIC affiliated with any insurance providers. These are some insurance providers some renters have used, please note there are others available that are not listed: Allianz insurance, Travel Insured International, CSA Travel Insurance.
DAMAGE, KEY, EXCESSIVE CLEANING, AND MISSING INVENTORY: You are responsible for the cost of all damage to the rental trailer occurring during your rental, which includes the cost of repair or the actual retail cash value of the item damaged, including, but not limited to, parts, labor, diminished value of the trailer, loss of use and revenue, missing equipment, excessively soiled linens, excessive cleaning and a reasonable charge to cover administrative expenses. The trailer and its attached equipment is not to be moved in any way by you or any other person, doing so will result in a loss of the security deposit at a minimum. All AIC rentals are non-smoking. This includes vaping and use of medical marijuana. Smoking of any kind inside the rental trailer will result in an additional charge as required for excessive cleaning. The trailer must be emptied of all items you brought with you. All trash must be removed. All kitchen items must be cleaned and returned to their storage place. Please sweep the floor but mopping is not necessary. All rentals will require a $500.00 security deposit that will be charged to the card on file 30 days prior to your rental. Any damage, loss of rental equipment, or excessive cleaning costs will be deducted from this security deposit and will be itemized for you. Labor rates will apply at $100 per hour. Please note AIC is not responsible for loss, damage, or injury to your personal property, or that of your party.
LOST AND FOUND: AIC is not responsible for personal items lost or stolen during your stay or items left in rental trailer(s) after your departure. If you believe you lost an item or left something behind, AIC will check for personal items; however, we make no guarantee we will find the item(s) or be able to return the item(s) we may find. If you believe you left an item behind, please contact us immediately to arrange for return or pick up from our operation yard. If AIC finds any item(s) you left inside the trailer, we will attempt to contact you by phone or email on file. Returned items will include a $25 handling fee in addition to the cost of packaging and shipping. AIC will make every effort to return items based on your desired shipping carrier; however, please understand AIC will ship items at its discretion and choose shipping carriers and terms available regardless of your preference. Any lost or found items not claimed 48 hours after your departure date and after AIC has attempted to contact you will be discarded.
CPAP AND SLEEP AID MACHINES: If you require the use of a continuous positive airway pressure (CPAP) machine during your trailer rental stay, please consider staying at a campground or RV park that offers standard household electrical hook ups (110volt). You will need to verify if electrical hook ups are available directly with the campground. This will ensure that you have full use of the trailer and your CPAP machine. If you choose to stay at a “dry” campground that does not offer electrical hook ups, you need to consider how it may affect your CPAP machine’s operation and your comfort. The electrical outlets in your trailer rental will not function unless you have a generator or electrical hook ups. As a general rule in most campgrounds, generators are not allowed to run through the night. Some of our trailer rentals are equipped with a 12volt DC outlet (similar to a car cell phone charger port and or USB style port) that you may be able to use if you have the proper adapter for your particular CPAP machine. This DC outlet (if equipped) may not be located near the bed you plan to use in the rental trailer. Please note, using the dc outlet most likely will not be able to provide adequate power through the night and will result in a significant draw from the rental trailer batteries. The batteries may become depleted as a result of excessive use with the CPAP machine. Excessive use resulting in the need to replenish or replace the batteries on your trailer rental may result in an additional service charge. Your comfort during your stay is our top priority. Please inquire with our rental staff prior to your stay if you need more information or have any questions.
DISCREPANCIES, GRIEVANCES, AND DISPUTES: Any discrepancies or grievances with equipment or rental trailer must be reported immediately to AIC and during your stay. Failing to immediately report any discrepancy or problem with the rental trailer or equipment will affect the comfort and quality of your stay and any compensation. You agree to have any dispute arising out of the matters regarding this rental contract and included in the terms and conditions decided by neutral individual arbitration as provided by California law and you are giving up any rights you might possess to have the dispute litigated in a court or jury trial. By agreeing to the terms and conditions and paying for your equipment or rental trailer you are giving up your judicial rights to discovery and appeal, unless those rights are specifically included in the “arbitration of disputes’ provision.
NATURE, ANIMALS, AND RODENTS: You and renters, occupants and operators acknowledge and understand that camping in forested and rural locations increases the chance of encountering wild animals, rodents and insects in campgrounds, campsites and in rental trailers. AIC makes every effort to rid the rental trailer and equipment of insects and rodents prior to your stay including the use of non-toxic deterrents. You may see these deterrents during your stay. AIC may not have been successful in completely ridding your rental trailer of all insects, rodents, or wild animals prior to your stay. You agree you will not hold AIC liable for any monetary compensation, damages, or injuries as a result of any encounters with nature, animals, rodents, or insects. You agree to properly store all consumable food items in proper animal resistant food lockers (bear boxes) located at each campsite. You understand storing food items outside bear boxes including inside ice chest coolers or inside the trailer may attract animals including bears. Any damage to the trailer by any animal including bears will result in an additional charge to you.
GENERATORS AND POWER: Renter understands the use of a personally owned or rental of a generator in combination with the trailer rental does not guarantee all appliances within the rental trailer will operate. Renter understands some appliances within the rental trailer have certain power requirements (including but not limited to the air conditioner (a/c) unit and microwave) and may or may not operate even under ideal conditions while the generator is operating. If the renter is in need of guaranteed power requirements, the renter shall make sure the proper size generator is available and included with the rental trailer and/or ensure the rental trailer is parked within a full hookup RV park with adequate electrical available. The rental is equipped with batteries and a 12 volt DC system. The power stored in these batteries may or may not last the entirety of your rental stay. The rental is equipped with solar; however, solar charging may be effected by weather or shaded areas of campgrounds from trees or other issues. You should conserve your power and make sure all electrical items are off when not in use. AIC recommends not using the charging ports located in the trailer for any reason, especially to charge phones or other battery operated equipment including electric bicycles. Charging these types of items will quickly deplete the rental batteries.
RV PARKS AND CAMPGROUNDS: AIC is not affiliated with any government or privately owned RV park or campground and operates independently of these facilities. AIC does not guarantee specific campground or campsite opening, hold spaces, or park and set up trailers in any facility without pre-arranged terms from the renter. AIC does not guarantee any services advertised or promised by campground or RV park facilities including but not limited to electrical power, sewer hookups, water, or TV and cable hookups.
INCLUDED ITEMS AND EQUIPMENT AND WHAT YOU NEED TO BRING: Economy and Standard rental trailers come equipped with a basic set of dishes, eating, and cooking utensils to accommodate the number of people the trailer sleeps. There is a basic set of pots and pans, and a stove top percolator coffee pot. We provide one (1) complimentary roll of paper towels, one (1) roll of toilet paper, one (1) bar of bath soap, and small container of dish soap. The refrigerator, furnace, water heater, water pump, and interior lights will function using the propane and 12 volt batteries provided with your rental. Standard household appliances using 110-volt electricity (including but not limited to air conditioning unit (a/c), microwave, wall outlets, TV/DVD player) will not operate unless your trailer is in a RV park connected to 110-volt (30 or 50 amp) electrical hook-ups or you bring or rent a proper generator (see generators).
Ultimate trailer: These rental trailers come equipped with all standard trailer items and TV/DVD, 3100 watt generator, blender, toaster, four (4) folding camp chairs, two (2) lounge chairs, a gas BBQ or griddle, an outside table and 12’ x 12’ mat, and firewood (one bundle for each paid night).
All rental trailers include propane, charged batteries, solar panel charging system, outside shade awning, one full fresh water tank, one empty gray water tank, and one empty black water tank.
The rental does not include and you are required to bring bed linens or sleeping bags, pillows and towels as well as food and beverage and any other cooking, bedding or camping items you wish to use.
HOLDING TANKS: Capacity of holding tanks vary based on trailer model. The lighted capacity gauge located inside the trailer is a guide and may or may not be accurate. The waste holding tanks are emptied with a vacuum pump system and rinsed after each use; however, occasionally the waste tank indicators remain lit even though the tank is empty. In this case, visual confirmation is made that the tank is empty prior to your use.
FRESH WATER TANK: AIC will deliver the rental trailer to you with the fresh water tank full to capacity. You are not required to refill the tank; however, if after the initial water is used you wish to refill the water, it is your responsibility to fill the tank at the campsite using the provided hose or water jug. AIC does not guarantee providing enough hose to reach water spigots in campgrounds, nor does AIC guarantee water spigots will work or will have threaded ends capable of accepting a hose connection. You agree, if you fill the fresh water holding tank, you will only use potable water. Under no circumstances will the fresh water tank be filled with creek water, lake water, or any other non-potable liquid. Your safety and comfort are our primary concern. Please note the tank and fill receptacle is an open system capable of accepting any liquids introduced. Although AIC empties and flushes the tank after each rental and uses filtered and treated water to refill the tank, AIC cannot guarantee contaminants have never entered the water system nor can AIC guarantee the water in the tank is acceptable to drink. AIC routinely tests the water used to fill the fresh water tank for presence of contaminants; however, AIC strongly recommends using the fresh water tank only for bathing and using bottled water for drinking and cooking.
GRAY WATER TANK: The gray (and or galley if equipped) water tank is used to hold kitchen and bath sink/shower water. You may or may not fill the tank(s) during your stay. With proper conservation the capacity of the tanks should be sufficient. You may use the sinks and hold discarded gray water within the tanks during your stay at no extra charge. The tank will be emptied at the end of your stay included in your rental service fee. If the tanks fill to capacity during your stay and you wish to continue using the sinks and shower, you will need to arrange to have AIC empty the tanks for an additional service fee. This service will generally be provided during regular business hours and will be scheduled according to availability. If you are “dry camping” without sewage hooked up to an approved connection, you agree you will not dispose of gray water within the campground under any circumstances. Opening the gray water valve at your campsite and depositing any amount of waste water at your campsite will result in a loss of your security deposit.
BLACK WATER TANK: The black water tank is used to hold toilet water. With proper use and conservation, it should not fill to capacity during your stay. You agree to only use the toilet paper provided, or approved RV type toilet paper. You agree not to dispose of any foreign objects including trash or feminine hygiene products in the black water tank. Doing so will result in an additional charge including labor costs to retrieve items as they do not flush from the holding tank properly. The tank will be emptied at the end of your stay included in your rental service fee. If the tank fills to capacity during your stay and you wish to continue using the toilet, you will need to arrange to have AIC empty the tank at an additional service fee. This service will generally be provided during regular business hours and will be scheduled according to availability. If you are “dry camping” without sewage hooked up to an approved connection, you agree you will not dispose of black water within the campground under any circumstances. Opening the black water valve at your campsite and depositing any amount of black water at your campsite will result in a loss of your security deposit.
WATER CONSERVATION AND DROUGHT CONCERNS: California and the Eastern Sierras experience drought conditions on a regular basis. Water levels are much lower than normal and are suffering from consecutive dryer than normal winters. Residents and visitors to the Sierras have been asked to do whatever possible to reduce water usage. US Forest Service campgrounds with potable water supply are advertising water restrictions and asking campers with RV’s not to refill their water tanks. AIC has asked about the details of the restrictions; however, Inyo National Forest representatives had little details and referred to the blanket statement on the campground rental websites. In campgrounds where potable water is offered, water will remain on with restroom and spigot use available. It is unclear at this time how the campgrounds plan to restrict the refilling of RV water tanks. You should plan to use water in moderation and may not be able to use the hose for refilling the tank. In this case, extra jugs of water may be made available. Many campgrounds AIC serves do not offer potable water on site. In this case, refilling water tanks must be done using a water jug and funnel provided with your trailer. There are several privately owned full hook up RV parks in the area and offer an alternative to water refilling issues.
